Exempt Development is minor, low impact development that does not require any formal planning or construction approval from Council or a Private Certifier.
Exempt Development can include certain small scale development such as minor building alterations, decks, pergolas, garden sheds, carports, retaining walls, fences, hard stand spaces, paths, paving & the like.
Development is only Exempt Development if it is listed in the Exempt Development Code & must meet the minimum development standards as specified in the Code.
Exempt Development must also meet the deemed-to-satisfy provisions of the Building Code of Australia (BCA), or if there is no such provisions, must be structurally adequate and installed in accordance with manufacture's specifications that comply with the BCA.
Exempt Development is not permissible on land that is within a wilderness area, critical habitat or on land that is listed on the State Heritage Register or that is subject to an interim heritage order.
Although no formal approval is required for Exempt Development, we are regularly engaged to prepare Exempt Development Reports to advise whether proposed works or as-constructed works meet the requirements for Exempt Development under the SEPP (Exempt & Complying Development) Codes 2008.
